WA:Short term fire chief to guide WA changes
PERTH, Aug 24 AAP - A new chief for Western Australia's main firefighting agency will
be appointed for 12 months while a new position of fire commissioner is being created,
Premier Colin Barnett says.
The new commissioner role is a recommendation of former Australian Federal Police commissioner
Mick Keelty, contained in his scathing report into February's Perth Hills bushfires in
which 71 homes were destroyed.
Mr Barnett on Wednesday continued to defend his embattled Police and Emergency Services
Minister Rob Johnson, who is facing calls for his sacking following Mr Keelty's report.
The report found the Fire and Emergency Services Authority (FESA) failed to comply
with its own procedures and policies.
It said FESA also had a poor relationship with other agencies, including the Department
of Environment and Conservation and volunteer firefighters, that led to a lack of coordination
and cooperation during the fires.
FESA head Jo Harrison-Ward was sacked last week in the wake of the Keelty report.
Mr Barnett said a new chief executive officer would be appointed within two weeks,
probably on a 12-month contract, to implement recommended changes within FESA.
The CEO position has been a five-year contract.
The premier said the government would meanwhile introduce legislation to make FESA
a government department and create a Fire and Emergency Services Commissioner who would
oversee all the state's firefighting agencies.
He told Fairfax Radio he thought it "a bit unfair" to say that FESA became a mess under
Mr Johnson.
The dysfunction within FESA and its relationship with other firefighting agencies had
not been seen to be as bad as it was, the premier said.
"I think there have been troubles brewing there and obviously they had got to a point
that was not recognised.
"The Keelty report has flushed that out and we will act on it."
Mr Barnett said Mr Johnson was responsible as a minister in having to accept what had
happened and play a role in fixing things.
"He can't walk away from that, nor can I.
"Rob's the minister, he's got my support, he and I will work on that and an appointment
will be made in the next couple of weeks."
Mr Barnett said there was a running debate about Mr Johnson's position "because he's
in the crosshairs".
"Ministers at times come under a lot of pressure.
"Rob's under a lot of pressure over this because a fire happened, 70 houses were lost,
thankfully no lives were lost, and a report was commissioned that showed some serious
weaknesses within FESA.
"That is not something that can be pointed at any one person, including Rob Johnson,"
Mr Barnett said.

29 April 2011 - German online lender and brokerage Comdirect Bank AG (ETR:COM) said on Thursday its first-quarter 2011 net profit gained 16% in annual terms to EUR18.2m (USD26.9m).
Profit before taxes rose to EUR24.9m in January to March 2011 from EUR21.2m in the same period of 2010.
Net interest income after provisions expanded to EUR33.1m from EUR23.9m, while net commission income added 29% on an yearly basis to EUR50.1m.
Assets under management rose by EUR4.9bn in annual terms to EUR42.5bn at 31 March 2011 but were flat from the prior quarter.

WA:Four die on WA roads over weekend
Four people have died on Western Australian roads over the weekend .. three of them
in motorcycle accidents.
Police say a man was killed just before midday today when he came off his motorcycle
in Chittering .. about 55 kilometres north of Perth.
In a separate incident .. a 24 year old female motorcyclist who struggled with strong
winds was killed in the southern Perth suburb of Leeming yesterday evening.
A 67-year-old man also died yesterday morning when his car collided with a truck on
the Great Northern Highway in the Wheatbelt region.
Earlier in the weekend .. a 19-year-old man died in a motorbike accident in Bunbury
.. south of Perth .. on Friday night.

CANBERRA, Aug 30 AAP - Federal Nationals leader Warren Truss has rejected suggestions
his party failed to deliver benefits for regional Australia as a junior partner in the
Howard government.
The Nationals met in Canberra on Monday for the first time since the August 21 election.
Mr Truss said it was not right to say the Nationals had failed regional Australia during
almost 12 years of the Howard government when asked about independent MP Bob Katter's
criticism of his former party.
"I do think we need to do more for regional Australia, I do not accept that nothing
was done for regions during that period," he told reporters.
"We will stand up for regional Australia and make sure that we deliver a share of our
nation's growth and prosperity back to the regions."

Fed: Abbott a capital "r" risk to the economy - Rudd
HOBART, April 22 AAP - Prime Minister Kevin Rudd says the opposition's calls to wind
back stimulus spending represent a "capital R risk" to the economy.
Mr Rudd said plans from Opposition Leader Tony Abbott to wind back stimulus spending
would undermine precarious regional economies.
"This plan from Mr Abbott would cause economic chaos and would pull the rug from under
the economy," Mr Rudd told reporters in Hobart on Thursday.
"Literally thousands of small businesses would go to the wall.
"On the economy, Mr Abbott represents a capital R risk."
Mr Abbott said on Thursday the Howard government could take a lot of credit for Australia's
strong showing in a recent international report.
In its latest World Economic Outlook released on Wednesday, the International Monetary
Fund (IMF) now expects Australian growth to reach 3.0 per cent in 2010, up from a forecast
of 2.5 per cent in January.
It expects growth to accelerate to 3.5 per cent in 2011, following 2009 growth of 1.3
per cent, almost double the rate the IMF had forecast.
Mr Rudd dismissed Mr Abbott's claims, saying the strong showing was due entirely to
stimulus spending.
"He should focus on one core fact, and that is that he and his party opposed the government's
national economic stimulus strategy," he said.
"That strategy has been validated by the World Bank, the International Monetary Fund
and the OECD as the basis upon which the economy stayed out of recession.

QLD: Southeast Queensland put on fire alert
BRISBANE, Dec 8 AAP - Parts of Queensland have been put on fire alert, with two grass
fires already burning out of control in the state.
Several fire crews are battling to contain a fire burning at Biarra, between the Esk-Crows
Nest Road and the Brisbane Valley Highway.
A grader has been brought in to help create containment lines.
Meanwhile, a large grass fire is burning for its sixth day in inaccessible areas near
Wooderson in central Queensland.
Fire crews are continuing to monitor the fire.
The Bureau of Meteorology (BoM) has issued a severe fire danger warning for the Darling
Downs, Granite Belt, Maranoa and Warrego districts in the state's southeast.
The Queensland Fire and Rescue Service said fires will be uncontrollable and fast-moving.
The warning will continue for Wednesday for the Darling Downs and Granite Belt district.
Temperatures are expected to climb to 41 degrees.

Fed: Credit growth sinks to a 15-year low

CANBERRA, April 30 AAP - The federal government will be under pressure to extend its
more generous first home owners grant in some form after new data showed mortgages are
propping up the credit industry.
Weak business confidence and households fretting about their job prospects has meant
other forms of credit are in a slump.
Prime Minister Kevin Rudd has previously hinted that the increased grant announced
as part of last October's first stimulus package will end as scheduled on June 30.
But his Finance Minister, Lindsay Tanner, has said it remains under consideration in
putting together the May 12 budget.
Reserve Bank of Australia (RBA) data released on Thursday showed total credit grew
just 0.1 per cent in March to be 4.9 per cent higher than a year earlier - a 15-year low.
Twelve months ago, annual credit was racing along at more than 15 per cent.
The breakdown is grim.
Personal credit - other than home loans - has tumbled to a 32-year low, while business
credit is at an eight-year low.
This is despite official interest rates being at a 39-year low.
And while housing credit is at a 26-year low, the pace of growth far outstrips other
forms of credit.
"Today's credit data ... will keep pressure on the government to retain the increase
in the first home owners grant - or at least some form of it - which has lent considerable
support to the lower end of the housing market," RBC Capital Markets senior economist
Su-Lin Ong said.
The grant was doubled to $14,000 for purchases of established homes and trebled to
$21,000 for new properties.
ANZ chief executive Mike Smith said the government's two stimulus packages and boosted
grant has helped prop up the banking industry, and maintained a degree of turnover and
activity in the housing sector.
ANZ reported a 28 per cent plunge in first half profit on Wednesday after bad debts
and losses on derivative trades spiked.
Mr Smith predicted official interest rates may fall again, but couldn't promise the
cuts would be passed on to borrowers.
"It's a question of what we can do at the time," Mr Smith told ABC Radio.
The major banks managed to pass on only a fraction of this month's 25 basis point cut
by the RBA because of high wholesale funding costs.
Still, first home buyers are taking advantage of the grant and low mortgage rates,
making up a record 26.9 per cent of all new mortgages.
New home approvals are showing improved signs of growth after months of decline.
But an Australia National University academic said the grant is just encouraging Australians
to jump into the "sinking ship" of an over-priced property bubble about to deflate.
"As the recession bites and interest rates start to rise because of a rapidly increasing
public debt, our bubble will deflate," Professor Quentin Grafton of the Crawford School
of Economics and Government said.
"As it deflates over the next two years it will both exacerbate and lengthen the recession
in Australia. People will feel less wealthy and will spend less. Construction will fall
off resulting in job losses and this will multiply through the rest of the economy."
In March, housing credit grew 0.6 per cent for an annual rate of 7.2 per cent. This
included a 0.8 per cent increase in owner-occupied loans, an 8.5 per cent rise over the
year.
Personal credit declined for a 10th straight month, down 0.3 per cent in March for
an annual drop of 6.2 per cent.
Demand for credit from business fell 0.6 per cent, growing at just 4.1 per cent in
the past 12 months.
The data coincided with National Australia Bank's quarterly business survey that showed
companies are at their most pessimistic about the outlook in more than 20 years.
"Clearly business is expecting further significant deterioration in economic activity,"
NAB chief economist Alan Oster said.
"Given these outcomes, it is not surprising that business is positioning itself for
tough times ahead."

NSW: Men found alive after NSW light plane crash
Two men who went missing after their light plane crashed in rugged NSW terrain have
been found alive.
A truck driver received a distress call from the pilot of a light plane on his UHF
radio yesterday afternoon.
The crew of a NRMA CareFlight helicopter spotted the two men this morning beside their
upturned single engine Cessna .. on the side of a steep ravine in The Great Dividing Range
near Merriwa in the Upper Hunter.
The 38-year-old pilot and his 32-year-old passenger had left Mudgee on a 380km flight
to Glen Innes.
It's not known what injuries the men have sustained.

VIC: Undertaker charged with underhand behaviour
MELBOURNE, Aug 19 AAP - A Melbourne undertaker has been charged after allegedly stealing
from the homes of clients.
Police today charged a 36-year-old Hawthorn East man with theft and indecent behaviour,
alleging he stole items from people's homes while arriving to collect their deceased loved
ones.
He has been charged with five counts of theft, two counts of indecent behaviour and
two counts of wilful and obscene exposure.
The offences are alleged to have occurred in the past six years, during which the man
has worked at a funeral home.
A police spokeswoman said it would be alleged the man stole items from homes while
he was also collecting their deceased relatives for funeral preparations.
The spokeswoman said the indecent behaviour and wilful and obscene exposure offences
were alleged to have happened outside the man's work.
The man was arrested at his home this morning as part of an ongoing investigation.
He was bailed to appear at the Melbourne Magistrates Court on September 30.

SA: High school students to travel to Western Front
ADELAIDE, Dec 9 AAP - Five South Australian high school students will travel to the
World War One battlefields of the Western Front to commemorate Anzac Day next year.
Premier Mike Rann today announced the winners of the Premier's Anzac School Prize 2008,
held for the first time this year, that gives students the chance to travel to the battlefields
of Europe each year.
"We all know the importance of our young people appreciating the sacrifices made in
war time by generations of Australians," he said in a statement.
He said the prize was aimed at encouraging more young people to learn about Australia's
role in world battles.
"The winner's of this year's prize will have a once-in-a-lifetime opportunity to visit
World War I battlegrounds and to take part in Anzac commemoration ceremonies in Europe,"
Mr Rann said.
"The students will be part of the 90th year commemoration of significant battles fought
in 1918 that led to the end of World War One."
The winning students were from Loxton in the state's Riverland, Port Pirie, suburban
Marion and two from Gawler, north of Adelaide.

With beers and two-up in Iraq .. and cheers and tears at home .. Australians yesterday
marked the 92nd Anzac Day with solemnity and gratitude.
From Brisbane to Baghdad and beyond .. Australians honoured the Anzac spirit of sacrifice
forged in Turkey in 1915 .. and saluted the 100 thousand war dead they have suffered since.
But the day was not without controversy .. from isolated incidents of vandalism to
rows over a Queensland rock concert .. and continuing dissent over the presence of Australian
troops in the Middle East.
At Adelaide's dawn service .. Anzac Day Committee chairman BILL DENNY said the original
Anzacs would be saddened by the indiscriminate slaughter of the four-year war in Iraq.
He says they would scrutinise Australia's deployments in the Middle East and would
be happy that our casualty rates are low .. but saddened at the indiscriminate slaughter
in which we've become mired.
Mr DENNY says in nine short weeks .. the war in Iraq will have been waged longer than
World War I .. with questionable progress and no end in sight.

NSW: Sydney man refused bail on multiple child sex offences
SYDNEY, Aug 17 AAP - A man charged with committing multiple child sex offences against
a 15-year-old boy has been refused bail by a Sydney court.
Keith Coles, 67, faced Burwood Local Court today after being charged with attempting
to have sexual intercourse with a child aged 14 to 16, and three counts of aggravated
indecent assault.
It is alleged Coles assaulted the boy at a Liverpool Road unit in Croydon between 3pm
and 4.30pm (AEST) yesterday.
Following a report to police, the unit was raided about 3.30am (AEST) today, leading
to Coles's arrest.
Magistrate Jane Mottley today refused Coles bail, and adjourned the matter to the same
court on Monday, August 21.

A court's been told a Seven Network current affairs report into rorts in the music
industry .. made a vicious attack on radio host KYLE SANDILANDS' reputation.
The co-host of the morning breakfast show on Sydney's 2Day FM .. who was also a judge
on last year's Australian Idol .. is suing Seven for defamation in the Supreme Court of
New South Wales.
It relates to ads aired on July 29 .. 30 and 31 last year .. promoting a segment on
Today Tonight.
It also relates to the show's investigation into the manipulation of Australia's billion
dollar music industry that screened on August 1.
The lawyer representing SANDILANDS says the segment was dressed up to be a special
investigation into the industry .. but was actually an attack on the DJ's reputation.
The hearing continues.

HOBART, Dec 13 AAP - Four whales have been found stranded on a beach in northern Tasmania.
Campers discovered the mammals, believed to be sperm whales, on a stretch of Bakers
Beach in Narawntapu National Park about 11.30am (AEDT) today.
Parks and Wildlife spokeswoman Liz Wren said a rescue team was headed for the site,
but it was too early to say if the whales could be saved.
"There were three live whales and one that appears to be dead and they think that they
are sperm whales," Ms Wren said. "It hasn't been confirmed, but just because of their
size it's thought they're sperm whales."
Ms Wren said the whales were eight to 10 metres long and were believed to be stranded
about 100 metres up the beach.
A spotting plane was despatched to see if there were any other whales in the area.
Ms Wren said a rescue team of more than 15 people - including marine conservation specialists
- was headed for the site under a joint operation by the Department of Primary Industries,
Water and Environment and Parks and Wildlife.
"Because they're such big animals, rescue is problematic, but there have been successful
rescues, it just depends on how far up the beach they are, how big they are and what condition
they're in."
Rescuers will pour water over the whales to keep them cool while plans to return them
to the water are devised.

Fed: Wattyl workers see red over 'blob' jibe
SYDNEY, April 4 AAP - About 350 Wattyl paint workers in five states were on strike
today to protest against a leaked management email in which unionised employees were referred
to as "blobs".
The Liquor Hospitality and Miscellaneous Union (LHMU) said an email was sent out to
company management last week which illustrated "ugly and disrespectful" tactics towards
union members, according to the union's national secretary Jo-anne Schofield.
The company has disputed the claim and said the strike action was sparked by a breakdown
in negotiations for a new workplace agreement.
"An email was sent out last week giving instructions on how to `prevent a blob from
entering the site'," Ms Schofield said.
"Top management are talking about loyal workers ... as if they were expendable splotches,
dribbles and smudges to be wiped out at will."
About 350 union members at the firm's NSW, Victorian, Queensland, South Australian
and West Australian factories went out on strike on Friday.
They will return to work on Wednesday, Ms Schofield said.
The union is currently negotiating a new enterprise bargaining agreement (EBA) for
Wattyl factory workers.
It wants a five per cent per annum pay rise and improved redundancy payouts, while
the company has offered a four per cent per annum wage rise.
A spokesman for Wattyl confirmed that no production or product shipping had taken place
since Friday, but no serious shortages were anticipated.
He said he was not aware of any email in which unionised employees were criticised.
"We certainly wouldn't be referring to anybody as blobs," he said.

FCC Broadband Testing Confirms That Verizon FiOS Delivers Blazing-Fast Internet Speeds Even During Times of Peak Usage.
Report Shows That FiOS Internet Performs Exceedingly Well
NEW YORK, Aug. 2, 2011 /PRNewswire/ -- The Federal Communications Commission's just-released report on residential wireline broadband service, "Measuring Broadband America," confirms that Verizon FiOS Internet customers receive blazing-fast and sustained upstream and downstream speeds even during peak usage periods.
The FCC's broadband performance tests, conducted earlier this year by SamKnows, an independent company that tests broadband speeds, measured the speed and performance of major wireline Internet service providers nationwide. The results of the nationwide tests, issued Tuesday (Aug. 2), show that Verizon's all-fiber-optic-based FiOS Internet service performs exceedingly well at all hours including during the most active hours of broadband use: between 7 p.m. and 11 p.m. on weekdays. The test results also show that Verizon FiOS Internet customers are receiving speeds that meet or exceed those advertised by the company.
The report compares each ISP's test results with the ISP's advertised speeds. Verizon's FiOS service delivered 114 percent of its advertised download and upload speeds when measured during peak periods. This was the highest percentage of any ISP participating in the test. The report also concludes that "fiber-to-the home has the best performance for latency" and demonstrates that Verizon's FiOS service loaded Web pages faster than any other tested ISP.
"The Verizon FiOS Internet experience remains second to none because our 100 percent fiber-optic technology is a network ahead," said Eric Bruno, Verizon vice president of product management. "FiOS Internet customers get an excellent experience for today's digital lifestyle, which includes streaming favorite TV shows and movies, uploading photos to the Web, running multiple online devices in the home, downloading large amounts of data, video chatting and online gaming.
"It's critical that consumers have a reliably fast downstream and upstream connection because more and more households are connected with multiple devices, which means greater demands are being placed upon networks," Bruno said.
The FCC announced plans last year to conduct the broadband tests, saying that measuring and publishing data on the actual performance of fixed broadband services would provide more information to consumers and thereby "promote meaningful competition and spur innovation."
Verizon's FiOS service options performed well in the speed tests, and the company's most popular speed options - 25 megabits per second (Mbps) downstream/25 Mbps upstream and 35/35 Mbps - fared exceedingly well. Specifically, the typical study participant using the 25/25 Mbps FiOS Internet tier received a sustained download speed of 28.77 Mbps between the peak usage hours of 7 p.m. and 11 p.m. on weekdays.
Similarly, the typical study participant using the 35/35 Mbps FiOS Internet tier received a sustained download speed of 40.42 Mbps between 7 p.m. and 11 p.m. on weekdays. These symmetrical services not only provided consistent downstream speeds, but also delivered to consumers upstream speeds that are unmatched by any competitor. These upstream speeds, shown in the report as averaging four to six times faster than those of the closest competitor, are critical for the growing number of applications that require fast, sustained upload speeds.
"This report gives the FCC and consumers a snapshot of today's competitive broadband marketplace," said Kathleen Grillo, Verizon senior vice president for federal regulatory relations. Although the broadband speed study confirms consumers have a wide array of choices for speeds and services, Verizon will continue to work to innovate and further differentiate its services from competitors.

When award is not a word.
Too many film and television awards. Executives in the entertainment business like to complain about the large number of U.S. and international TV trade shows, but has anyone noticed the proliferation of film and TV awards, especially in the U.S.?
Inflation has certainly hit the audiovisual sector as well. The growing number of stand-alone awards and those associated with trade shows is really becoming unmanageable, like the U.S. economy.
And the U.S. studios seem to be getting fed up with this award inflation, especially the Golden Globes, which are given out by the Hollywood Foreign Press Association (HFPA).
If one counts only the number of major TV and film awards in the three month period from November 2010 to February 2011, the figure reaches an astronomical 27 events. This is without counting local and regional events and film and TV festival awards, which could easily double that figure. In effect, for the four winter months there is one award ceremony every other day. And if other awards bestowed during the remaining months of the year are considered, one can easily see how this wave of statuettes is engulfing the entertainment industry. If, on the other hand, international awards were also to be included, the industry could easily be paralyzed by a gridlock.
Just before this article was completed, the I Los Angeles Times came out with a story decrying the time when "Hollywood had one award ceremony that mattered: The Oscars." The paper then continued with the theme of this article that, "Today, countless guilds, critics groups and film festivals bestow ... all prizes from [September] to late February."
The Times, however, added the twist that, "Some Oscar contenders [reluctantly] put their careers on hold for nearly half a year as they bounce among banquets, red carpets, panel discussions and other fetes."
So crowded is the U.S. award calendar that some industry observers are even suggesting moving the Oscars to late January from the recent late February dates. This would be the fourth date change for the Oscars (originally it was in mid-April, later moved to late March), but would result in the Golden Globes moving back as well.
The studios' venom against the Golden Globes stems from the fact that, among HFPA's 90 members, only a few of them writeforrecognized non-U.S. publications, and when they do, they're minor stringers or free-lance. An Internet search indicated that some HFPA members write for their own websites, others are mainly would-be actors and others free-lance photojournalists. Criticism doesn't come only from the studios, but from the media itself. Here's how the HFPA is described in one report found on the Internet: "The association does not represent internationally renowned publications like Le Monde or The Times of London. Indeed, it has repeatedly rejected applications from Sue Kim, a Le Monde correspondent, while accepting applications from freelance writers from Bangladesh and South Korea."
Ironically, VideoAge contributed to the revival and ultimate success of the Golden Globes with an article in its October 1992 Issue, with the title crying, "Save HFPA." In that article VideoAge wrote: "As the Golden Globe Awards approaches its 50th anniversary, many people in the industry are revaluating the HFPA."
But, the Academy has to contend with other awards as well, which all contribute to removing the element of surprise from the Oscars. Three guilds representing producers, directors and actors--all of whom are voting Academy members--have their award ceremonies a month earlier, and thus they represent a solid indicator of which way the Oscars will be awarded.
In both film and television, awards are associated with excellence and can therefore be seen on par with adjectives such as "great," but grammatically the word "award" is both a noun (e.g., awardee) and a verb (e.g., awarded). It can also be an adjective (e.g., awardable).
Awards are also associated with extravagant costs and therefore increasingly unnecessary expenditures. At times, "award" is a word that some producers would like to remove from their vocabulary. The tact that the awards are losing their shine was first indicated in a New York Times story that pointed out how trade publications that depend mostly on award shows advertising are suffering a loss of revenue.

NBN's fibre exclusion plan 'will widen digital divide'.

Apr 18, 2011 (The Australian - ABIX via COMTEX) -- The Australian Computer Society opposes NBN Co's plans to deny fibre internet connections to seven per cent of businesses and houses. It argues in a submission to the Parliamentary inquiry into the $A36 billion national broadband network that the proposal would heighten the digital divide between regional and urban areas. The body says that, at best, non-fibre technology is only a short-term solution.

Internet Advertising Growth, Stability in Broadcasting, Solid Performance in New Merchandising Offerings Underscore Brand Strength, Lend Support in Challenging Print Advertising Market
NEW YORK, April 30 /PRNewswire-FirstCall/ -- Martha Stewart Living Omnimedia, Inc. today announced its results for the first quarter ended March 31, 2009. The Company reported revenue for the first quarter of $50.4 million, reflecting continued growth in Internet advertising revenue, stability in the Broadcasting segment, and new Merchandising initiatives, somewhat offset by a challenging magazine advertising market and expected lower guarantees and sales from Kmart as the relationship winds down.
Charles Koppelman, Executive Chairman and Principal Executive Officer, said, "MSLO's first quarter was consistent with our expectations. We believe our strong brands and broad visibility across media platforms and the nation's retail store shelves are helping the Company hold its own in this recessionary environment. First Quarter 2009 Summary
Revenues were $50.4 million in the first quarter of 2009, compared to $67.8 million in the first quarter of 2008. Lower revenues primarily reflect declines in print advertising revenue during a challenging period for the magazine industry, as well as the expected decrease in the minimum royalty guarantees and sales from Kmart compared with a year ago. The Company's Broadcasting and Internet segments performed solidly, as did new Merchandising initiatives.
Operating loss for the first quarter of 2009 was $(15.5) million, compared to $(4.5) million for the first quarter of 2008. Included in the results is an impairment charge of $(7.1) million related to an equity investment. When excluding the impairment charge recorded in the quarter, operating loss was $(8.4) million for the quarter.
Adjusted EBITDA loss for the first quarter of 2009 was $(5.0) million, compared to $(1.2) million in the prior year period. The negative impact to Adjusted EBITDA from revenue declines was partially offset by cost savings in the Publishing and Merchandising segments as well as the reduction of the compensation accrual and lower compensation costs across the businesses.
Net loss per share was $(0.31) for the first quarter of 2009, compared to $(0.08) for the first quarter of 2008. Included in the results is an impairment charge of $(7.1) million or $(0.13) per share for the quarter related to an equity investment. When excluding the impairment charge recorded in the quarter, net loss per share was $(0.18) for the quarter.

Revenues in the first quarter of 2009 were $28.4 million, compared to $40.8 million in the prior year's first quarter, due to lower advertising pages, timing of special issues and softness in newsstand revenue.
Operating loss was $(1.9) million for the first quarter of 2009, compared to operating income of $1.7 million in the first quarter of 2008.
Adjusted EBITDA loss was $(1.4) million in the first quarter of 2009, compared to adjusted EBITDA of $2.4 million in the prior year's quarter. The decreases in advertising and circulation revenues were partially offset by savings in production and consumer marketing costs, as well as lower compensation costs and the reduction of the compensation accrual.

Adjusted EBITDA was $1.0 million for the first quarter of 2009, up from $0.5 million in the prior year's first quarter due to the addition of Emeril programming and the reduction of the compensation accrual.

Operating loss was $(2.0) million in the first quarter of 2009, compared to operating loss of $(2.2) million in the first quarter of 2008.
Adjusted EBITDA loss was $(1.5) million in the first quarter of 2009, compared to $(1.8) million in the prior year's quarter, reflecting the reduction of the compensation accrual.

Total Corporate expenses were $(10.6) million in the first quarter of 2009, compared to $(10.7) million in the prior year's quarter. Adjusted EBITDA loss was $(8.6) million in the first quarter of 2009, compared to $(9.3) million in the prior year's quarter. The decrease in expenses in the quarter was largely due to the reduction of the compensation accrual and lower compensation costs, partially offset by an increase in severance and facility-related charges.

Use of Non-GAAP Financial Information
In addition to using net income to assess the organization's overall financial health, Company management uses net income before interest, taxes, depreciation, amortization non-cash equity compensation and impairment charges ("adjusted EBITDA"), a non-GAAP financial measure, to evaluate the performance of our businesses on a real-time basis. Adjusted EBITDA is considered an important indicator of operational strength, is a direct component of the Company's annual compensation program, and is a significant factor in helping our management determine how to allocate resources and capital. Adjusted EBITDA is used in addition to and in conjunction with results presented in accordance with GAAP. Management considers adjusted EBITDA to be a critical measure of operational health because it captures all of the revenue and ongoing operating expenses of our businesses without the influence of (i) interest charges, which result from our capital structure, not our ongoing business efforts, (ii) taxes, which relate to the overall organizational financial return, not that of any one business, (iii) the capital expenditure costs associated with depreciation and amortization, which are a function of historical decisions on infrastructure and capacity, (iv) the cost of non-cash equity compensation which, as a function of our stock price, can be highly variable, is not necessarily an indicator of current operating performance for any individual business unit, and is amortized over the appropriate period, and (v) non-cash impairment charges, which are impacted by macro-economic conditions and do not necessarily reflect operating performance.
Adjusted EBITDA provides a means to directly evaluate the ability of our business operations to generate returns on a real-time basis. We provide disclosure of adjusted EBITDA because we believe it is useful for investors to have means to assess our performance as we do. While adjusted EBITDA is a customized non-GAAP measure, it also provides a means to analyze value and compare our operating capabilities to those of companies with which we compete, many of which have different compensation plans, depreciation and amortization costs, capital structures and tax burdens. But please note that our non-GAAP results may differ from similar measures used by other companies, even if similar terms are used to identify such measures.
A limitation of adjusted EBITDA is that it does not reflect the periodic costs of certain capitalized tangible and intangible assets used in generating revenues for our overall organization. Management evaluates the costs of such tangible and intangible assets through other financial measures such as capital expenditures. Management also evaluates the cost of capitalized tangible and intangible assets by analyzing returns provided on the capital dollars deployed. A further limitation of adjusted EBITDA is that it does not include stock compensation expense related to our workforce. Adjusted EBITDA should be considered in addition to, and not as a substitute for, net income or other measures of financial performance reported in accordance with GAAP.

Paddy Power set for more growth this year.(News: Betting & gaming)
Morgan Stanley has upgraded its growth forecast for Paddy Power, moving the stock to 'equal weight' with a target price of 28 [euro], and its 2008-09 earnings per share raised by 7%-8%.
In a research note, the firm said "Paddy Power shares are down 20% since Ladbrokes' November profits warning, despite continued strong trading, leading us to raise forecasts by 7%-8%. We see further upside risks to forecasts, and with the shares one standard deviation cheaper than their average since listing (15x 12-month forward P/E), we see the shares as attractively valued."
The brokers identified four key areas that matter to investors, led by the fact that the Irish retail market remains resilient. "Despite the slowing economy and high supply growth in betting shops, the business continues to perform ahead of market expectations. With a strong brand and well located and high-spec estate, we see downside risk as limited ... from any slowdown in Ireland," it said.
Additionally, sports margins have stabilised. Morgan Stanley suggests that investors remain nervous about the volatility of sports margins, and potential structural declines, however, its analysis suggests that these should remain stable. It added: "There has also been high growth on the internet. As a late starter in 2001, Paddy Power's performance has been excellent, and it continues to outperform Ladbrokes, and William Hill's growth rates. Furthermore, the firm's expansion into Spain and spread betting could drive faster than expected growth.
"And not least, Paddy Power is benefitting from an attractive valuation. While headline P/E multiples look relatively high at 14x 2009e, the P/E is distorted by the cash position. A like-for-like balance sheet structure (3.5x debt/ebitda) would leave the shares at a discount to Ladbrokes, at under 11 x P/E in 2009e."
Paddy Power is also adding some 60 units over the next three years, doubling its UK estate. Its large-plan, bonus-led offer is proving attractive to customers, and JP Morgan sees strong growth prospects within this mature market. Although the firm's analysts believe the market is nervous about the economic sensitivity of the retail business ... "betting and gaming has historically been a resilient industry in a downturn, and we do not expect this to materially change in the current slowdown. Recent updates from Paddy Power, William Hill, Ladbrokes and a host of online gaming companies have confirmed that trading trends remain robust.
"Our analysis of historical betting patterns in the UK, US and Australia suggests that betting spend is resilient in a downturn, although not completely recession proof."
